SEATTLE (Recycling Monster): Maryland’s extended producer responsibility program for packaging was approved by the state’s legislative session on Monday. SB 901 now heads to governor’s desk. If signed by Gov. Wes Moore, Maryland would become the sixth U.S. state to implement EPR law for packaging.
Beverage containers and other paper and packaging items would be covered under the EPR law. A producer responsibility organization will set the fees and reimbursements. The reimbursements would pay for about half of the collection expenses. Additionally, the state will entirely fund the cost of processing and shipping related to recycling.

The bill aims to set a reimbursement rate so as to cover at least 50% of the cost by July 1, 2028, then 75% in 2029 and 90% in 2030.
Under the terms of the bill, a producer responsibility organization (PRO), approved by the Maryland Department of the Environment, would register each year starting July 1, 2026. The PRO needs to submit a five-year producer responsibility plan by July 1, 2028. In addition, PRO will also be responsible for setting performance goals for covered packaging materials.
Certain food carts, restaurants, small shops, and producers are exempt from the measure.
